Part C: Declaration of Originality
By signing this declaration, I confirm and warrant that:
(a)
The submission identified in Part B above is entirely my own original work and has not been copied, derived from, or based upon the work of any other person, entity, or existing design, slogan, character, or intellectual property.
(b)
The submission does not infringe upon any copyright, trademark, patent, trade secret, or any other intellectual property right of any third party, whether registered or unregistered, in any jurisdiction.
(c)
No part of the submission has been previously published, submitted to another competition, licensed, sold, or otherwise committed to any third party in a manner that would conflict with the rights assigned herein.
(d)
Where the submission incorporates any typeface, font, image, or other third-party asset, such asset is either (i) freely available under an open-source licence permitting commercial use, or (ii) properly licensed by me for the purposes of this submission, and I can provide evidence of such licence upon request.

Part D: Assignment of Intellectual Property If Declared Winner
I hereby irrevocably and unconditionally assign to the Virgin Islands Energy and Water Corporation (VIEWCo), if I am successful in any of the listed competitions:
(e)
All intellectual property rights, including but not limited to copyright, design rights, trademark rights, and any other proprietary rights, in and to the submission identified in Part B, in all formats, media, and territories worldwide, for the full duration of such rights.
(f)
The right to use, reproduce, modify, adapt, develop, publish, display, distribute, sublicense, and create derivative works based on the submission, in whole or in part, for any purpose related to VIEWCo’s corporate identity, branding, communications, marketing, merchandise, or any other lawful purpose, without further consent from or payment to me beyond the prize (if awarded).
(g)
The right to register or seek to register any trademark, design registration, or other intellectual property protection in respect of the submission or any element or adaptation thereof, in VIEWCo’s name.
I acknowledge and agree that:

This assignment takes effect if I am declared the winner of any of the aforementioned competitions.
•
I have no claim to further compensation, royalties, licensing fees, or any other payment in connection with VIEWCo’s use of the submission beyond the competition prize, if awarded.
•
VIEWCo is under no obligation to use my submission or any part thereof.
•
VIEWCo may, at its sole discretion, modify, combine, adapt, or further develop the submission for corporate use, and I waive any right to object to such modifications to the fullest extent permitted by law.
•
I waive any moral rights I may have in the submission to the fullest extent permitted by applicable law, including any right to be identified as the author or to object to derogatory treatment of the work.
Part E: Indemnity
I agree to indemnify, defend, and hold harmless the Government of the Virgin Islands, the Ministry of Communications and Works, VIEWCo, its Board of Directors, officers, employees, agents, and contractors from and against any and all claims, demands, damages, losses, costs, expenses (including reasonable legal fees), and liabilities arising out of or in connection with:
(h)
Any breach of the warranties given in Part C of this declaration;
(i)
Any claim by a third party that the submission infringes their intellectual property rights; or
(j)
Any inaccuracy or misrepresentation in the information provided by me in this declaration.
Part F: Acknowledgement of Competition Terms
By signing this declaration, I further acknowledge and agree that:

I have read and understood the VIEWCo Brand Competition Guidelines applicable to the competition category I have entered.

I accept the rules, judging criteria, and prize structure as published by VIEWCo.

The decision of the VIEWCo Board of Directors on the selection of winning entries is final and is not subject to appeal, correspondence, or legal challenge.

VIEWCo reserves the right to disqualify any entry that does not comply with the published guidelines or the terms of this declaration.
•
My personal information is collected and processed by VIEWCo solely for the purposes of administering the competition and is handled in accordance with applicable data protection requirements.
