Apply for a Conditional Permit

You are eligible to apply for a Conditional Permit if you find yourself in any of the following situations:
- You held an Entry Permit and have recently become unemployed by way of Termination, and desire to remain in the Territory while seeking new employment.
- You held an Entry Permit and have recently become unemployed by way of Resignation, and desire to remain in the Territory while seeking new employment.
- You held an Entry Permit and have recently become unemployed by way sale of a company, death of employer or otherwise, and desire to remain in the Territory while seeking new employment.

Before beginning your application, you are required to have:
- Resignation Letter and/or Release Letter/Lay-off Letter/Termination Letter;
- Bank Reference;
- Proof of Tenancy Letter from the Landlord/Owner/Agent of the Property reflecting your Name, Address, Landlord’s name and the two (2) most recent rent receipts OR a copy of your Lease Agreement and two (2) last rent receipts reflecting your name, address and land lord’s Name;
- A Valid Passport (including Dependents where applicable); and
- Supporting documents relevant to your circumstances (i.e.):
- Letter of Intent to hire from intended employer.
- Marriage certificate (if spouse of a Belonger) OR Family documentation (if applicable).
All documents must be clear, legible, and uploaded in the required format.

Step 1: Access the Online Application
Visit the Immigration eForms platform at:

Create an account or log in using your existing credentials.

Step 2: Complete the Conditional Permit Application
- Choose "Conditional Permit" from the list of available applications.
- Fill out all mandatory fields on the online form.
- Upload all supporting documentation.
- Before submitting your material, be sure to double-check it.
Applications that are incomplete may experience processing delays.

Step 3: Submit the Application
After submitting, you will receive:
- An acknowledgement notice.
- A special application reference number that you should save for your records.

Step 4: Pay the Application Fee (In Person)
Visit the Department of Immigration Headquarters (Tortola or Virgin Gorda) in person to pay an application fee of One Hundred Dollars ($100.00). Your application will not be reviewed or processed until payment has been made.

Steps 5: If Conditional Permit Is Approved
You are required to visit the Department of Immigration in person to:
- Pay the prescribed Conditional Permit fee of $250.00.
During your visit to the department please bring:
- Your valid passport;
- The applicable permit fees; and
- Any documents previously requested by the Department.
Your Conditional Permit will not take effect until payment is received and the prescribed stamp is affixed to your passport.

Step 6: If Conditional Permit Is Denied
As a Conditional Permit has not been granted, you are therefore required to report to the Department of Immigration, within one week of this notification, and make arrangements to depart the Territory. Your departure will facilitate a return while holding a valid Immigration Clearance (work permit) or a letter of intent to hire by a new approved employer (work permit exemption holders).
When attending the Department of Immigration, you are required to bring:
- Your valid passport, and
- A confirmed airline or ferry ticket showing your intended departure from the Territory.
Failure to comply with these instructions will result in your remaining in the Territory without the relevant permissions. To remain compliant with the Immigration Laws of the Territory we implore full cooperation.
Important Notice
- A refusal of a Conditional Permit does not negatively impact your ordinarily resident period if you remain out of the Territory for less than 90 days.
- Remaining in the Territory without lawful status constitutes a breach of Immigration laws.
- Non-compliance may adversely affect future immigration applications.
- You are free to appeal this decision by way of letter to the Chief Immigration Officer in writing at immenforcementunit@gov.vg. At which time a review of the grounds by which the appeal was lodge will be undertaken and a revised decision supplied.

Attendance at this appointment is mandatory. During the interview, you may be required to verify information submitted with your application and provide additional information where necessary.
If you are unable to attend on the above scheduled date, you must contact the Department of Immigration Enforcement Unit immediately to make alternative arrangements.
Failure to attend the appointment without prior notice may result in delays or denial of your application due to unresponsiveness.

Processing times may vary depending on your case.

Possession of a Conditional Permit does not confer an assurance of subsequent approval for any immigration-related application.
- Non-adherence to the stipulated conditions of the permit may lead to its cancellation or the initiation of enforcement measures.
- The submission of inaccurate or deceptive information constitutes a grave infraction which is an offense.

- The platform will notify you by email at varying stages of the process and when a decision has been made.
