Processing times for international legal assistance requests can vary depending on several factors, including the complexity of the request, the urgency of the matter, the legal systems involved, and the availability of required documentation.
Routine requests may take several weeks to process, while more complex or urgent matters may be prioritised for expedited handling. Applicants are encouraged to submit requests as early as possible and ensure that all necessary information is provided to avoid delays.
The Attorney General’s Chambers aims to process compliant requests within 30 to 90 business days from the date the request is deemed compliant.
Generally, there are no direct fees for processing MLA requests. However, certain costs may be incurred, including:
- Fees and reasonable expenses of expert witnesses
- Costs of legal representation during the interview of a suspect or accused, especially when the requesting party requires the presence of a defense lawyer
- Costs of an extraordinary nature, such as legal proceedings arising from challenges to the BVI's compliance with an MLA request, as agreed upon with the requesting state or jurisdiction

To request international legal assistance, a formal written application must be submitted to the Attorney General’s Chambers. The request should be made in accordance with any applicable mutual legal assistance treaties (MLATs) or other agreements between the Virgin Islands and the requesting country or organisation.
Steps to Submit a Request:
- Prepare the Request Letter
The letter must be issued by a competent legal or judicial authority and should include:- A clear explanation of the legal matter and its current status
- The type of assistance required (e.g. evidence collection, document service)
- Details of any persons or entities involved
- The legal basis for the request, including references to treaties, conventions, or domestic laws
- A justification for the assistance and its relevance to the investigation or prosecution
- Any specific procedures to be followed, especially if the request pertains to court-admissible evidence
- Include Supporting Documents
Attach any relevant court orders, warrants, background documentation, or translated material that may assist in processing the request.

Upon receipt, the Chambers will review the request and may contact you for clarification or additional documentation. The requesting party will be notified of the outcome and any next steps required.
Important Notes
- Incomplete requests or those lacking legal justification may result in delays or rejection.
- Urgent requests should be clearly marked and include justification for expedited handling.
- All information provided will be treated in accordance with applicable laws and international obligations.
Assistance may be refused if:
- The request is not made in conformity with applicable agreements or laws.
- The requesting party has not pursued all means available in its own territory to obtain the information, except where such means would give rise to disproportionate difficulty.
- The disclosure of the information requested would be contrary to the public policy of the BVI.
The BVI may decline to assist if:
- The request pertains to a political offense.
- The request relates to an offense under military law that is not also an offense under ordinary criminal law.
- The execution of the request would prejudice the sovereignty, security, or other essential interests of the BVI.
