Role Summary
The role of Magistrate is to hear and pass rulings in all civil, criminal and quasi-criminal matters filed in the Magistrate’s Court. Oversee and manage the operations of the Court in an efficient and competent manner to ensure a professional and fair judicial service is provided within the Court and to the public.
Main Responsibilities
1. To ensure the laws of the British Virgin Islands are adhered to, carry out the following duties in a professional manner:
a) Try persons charged with committing summary offences, as well as civil actions founded in contract pr tort (where the amount claimed does not exceed $10,000.00)
b) Conduct preliminary inquiries into indictable charges and forward resulting depositions to the High Court
c) Hear and determine applications made under the Domestic Violence Act and the Juvenile Act, as well as hear applications for Liquor Licenses
d) Hear and determine complaints laid by the Chief Physical Planning Officer under the Land Development Control Ordinance
e) Supervise execution of writs
f) Serve as Coroner and conduct inquests into unnatural deaths occurring within the territory
2. Performs any other duties as required by Senior Magistrate in order to contribute to the effectiveness and efficiency of the unit.
Minimum Qualifications
Bachelor’s Degree in Law
Bar Professional Training Course Certificate (BPTC)
Admitted to the BVI Bar or imminent Call or other common law Bar qualification
Certificate of Legal Education
Five (5) years related experience
Excellent knowledge of Government structure, policies and procedures
Excellent knowledge of applicable statutes and statutory interpretation
Excellent knowledge of relevant laws, regulations, ordinances, legislation, policies and procedures
Excellent leadership and management skills
Excellent legal research and report-writing skills
Excellent analytical and decision-making skills
Excellent oral and written communication skills
Excellent interpersonal and organisational skills
Ability to work well under pressure
