The public is hereby informed that the Director of Public Prosecutions has proffered complaints as a result of the Police investigations, to date, arising from the boat accident on 16^th October, 2021.  As there is sufficient evidence and that it is in the public’s interest to commence criminal proceedings, complaints were laid against Andrew Morrell for the following offences:

1. Manslaughter, contrary to the Criminal Code 1997 (as amended);
2. Causing Serious Injury to a Person while on Board a Vessel, contrary to the Merchant Shipping Act, 2001 (as amended); and
3. Failing to Render Assistance after a Collision, contrary to the Merchant Shipping Act, 2001 (as amended).

The Accused was arrested and charged by the Police on 12^th April, 2022.  The Accused was granted Police Bail with strict conditions, and is scheduled to be brought before the Magistrates’ Court on 31^st May, 2022.  The public is kindly advised that it is neither irregular, nor improper for persons to be granted bail for Manslaughter, which is a distinct offence to Murder.   The decision to make an offer of bail is determined on a case by case basis.  The issuance of bail to an Accused does not mean that the matter will not be properly adjudicated.

We are aware of the public interest in this matter, and remind the public that such investigations take time, and must be executed properly to ensure that there is due process for the victims as well as the accused.
